The compañero Fenix Ahumada Delgado was arrested at the end of 2008 accused under the anti-terrorist law of trying to burn trucks in the Temuco bypass. Fenix was arrested that night after a molotov cocktail was thrown at a police radio squad and they found drums of combustible material, tires, slings and balaclavas… The prosecution guessed their objective was to attack a forestry truck.

After spending several months in preventive prison Fenix managed to leave on nighttime house arrest, in this way evading the repressive siege and the legal process, refusing to attend the trial.

Three years later, on January 30th, 2013, Fenix was arrested in Rio Bueno during a gigantic operation raiding a series of houses and communities, detaining a series of Mapuche villagers accused of the arson of the Pisu Pisue estate.

The prosecutor Miguel Angel Velasquez, who brought the case for the bypass attack in 2008, decided to bring Fenix to a simplified trial no longer under the anti-terrorist law but under arms control, and he was sentenced on March 18, 2013 to 301 days in prison.
